WTO and International Trade

aopeng maintains one of the largest WTO and international trade remedy practices in China and is widely acknowledged as a market leader in this area. Our team of trade lawyers serves clients in anti-dumping, countervailing and safeguards actions taken by the Chinese government and other jurisdictions. The team led by the veteran counsel Mr. Lei Wang, a former trade negotiator in the Chinese Ministry of Commerce (MOFCOM), consists of two rising trade lawyers, Steven Yu and Lin Yang, and ten other lawyers with experience in trade work.

International clients that the team has served include well-known ones such as Arcelor steel, Yukos and American Paper & Forest Association.  Notable Chinese clients include Beijing Matsushita, Asia Dekor, Haier, Eagle Ceramics, Capital Steel, TCL and Belle Shoes. In the recent Chinese antidumping investigation on kraft linerboards, the team has successfully represented its international client to obtain a repeal of an anti-dumping order issued by MOFCOM through administrative re-consideration proceedings. This case has become a landmark case among the over 40 anti-dumping cases initiated by the Chinese Trade Authority (MOFCOM).

Anti-monopoly law

Competition practice is an important component of Gaopeng legal practices. Gaopeng began to advise the anti-monopoly aspect of the merger to clients when the first piece of merger control rules of China came into force in 2003.  After the PRC Anti-Monopoly Law (“AML”) came into effective on August 1 2008, the expertise of Gaopeng is well recognized with assisting a dozen of both multinational and domestic companies in the merger filing procedure with Ministry of Commerce (MOFCOM).

Gaopeng also advised a dozen of multinational and domestic companies on other anti-monopoly compliance issues including cartel, abuse of dominance, etc. Gaopeng provided anti-monopoly training, issue legal opinion, help clients to draft and improve internal anti-monopoly compliance guidelines, and revised relevant contracts according to the AML.

Gaopeng also represents clients in IPR infringement and anti-unfair competitions litigation and administrative procedure.
